Supreme Court rejects industry challenge of 2015 net neutrality rules

The federal government tonight returned to the Supreme Court, asking it once again to intervene in a dispute over the Trump administration's decision to end the program known as "Deferred Action for Childhood Arrivals", which allows undocumented immigrants who came to the United States as children to apply for protection from deportation.

The US Supreme Court has declined to hear the broadband industry's challenge of Obama-era net neutrality rules.

The "DACA" program - formally, Deferred Action for Childhood Arrivals - was created by the Obama Administration, and has spared almost 700,000 immigrant youths from being sent back to countries from which they came as children with their parents. The Justice Department has also agreed to suspend its recent suit against California over the state's new net neutrality law, at least until the case before the D.C. Circuit is resolved.

A Supreme Court ruling backing up the FCC's repeal could have made it harder for future administrations to reinstate net neutrality. In the letter, Francisco told the justices that "prompt consideration" of the three cases is essential because nationwide injunctions require the administration to keep the program in place while the litigation challenging efforts to end it continues. The court's notice says the three justices wanted to "grant the petitions, vacate the judgment of the United States Court of Appeals for the District of Columbia Circuit, and remand to that court with instructions to dismiss the cases as moot".

The reason Big Cable persisted in that challenge - even after the rules were struck down by Pai's FCC - is because it fears the decision will act as a legal precedent against the new rules when yet another lawsuit is heard. Under the Obama-era rules, Internet Service Providers (ISPs) were barred from blocking or throttling web content or creating the so-called internet "fast lanes".

Behind those two issues are a series of individual questions about the constitutionality of the shutdown and its legality under federal immigration and court procedure laws. The Trump administration is seeking to convince the Supreme Court to consolodate those cases because they make the same substantive objections to the planned DACA recession, and toss them all out on the merits.

"Today's decision is not an indication of the Court's views on the merits but simply reflects the fact that there was nothing left for the Court to rule on", the Internet and Television Association said. His work has appeared here since mid-2011.
